You must intend to apply for an Intervention Order or a Family Violence Safety Notice or you must reasonably believe that an order, Nationally Recognised Domestic Violence Order or notice has been issued against the person but not served.
You believe on reasonable grounds it is necessary to ensure the safety of the AFM or preserve their property.
You reasonably suspect that the person is 18 years or older.
Arrest powers have primacy. Do not use the FVPA holding powers if a power of arrest exists.
You must not interview/question for any offense or alleged offence while any holding power exists.
Detention powers can only be used if direction is refused or the person fails to comply with directions.
